The petitioner is in custody in connection with Jamo Bazar P.S. Case No. 03 of 2017 for the offence under Section 414 of the Indian Penal Code and Sections 25(1-b)a, 26/35 of the Arms Act.

Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent. He further submits that the petitioner has been roped in the instant case on the basis of secret information that his son was involved in unlawful activities. He further submits that the police after investigation submitted charge-sheet and the main accused Md. Sams Tabrej has already been granted bail by the court below itself. The petitioner is in custody since 18.10.2018.

Considering the fact that the petitioner has remained

Patna High Court CR. MISC. No.18547 of 2019(2) dt.27-03-2019 2/2 in custody for more than five months and he has got no criminal antecedent, the petitioner, named above, is directed to be released on bail on furnishing bail bonds of Rs.10,000/- (Rupees ten thousand) with two sureties of the like amount each to the satisfaction of Additional Chief Judicial Magistrate-XIII, Siwan in connection with Jamo Bazar P.S.
