2. Petitioner apprehends arrest in a case registered for the offences punishable under Section 30(a) of the Bihar Prohibition and Excise Act.
3 . As per the prosecution case , 150 liters illicit liquor was recovered from seized motorcycle .
4. It is submitted on behalf of petitioner that petitioner has falsely been implicated in this case only on the basis of suspicion . Petitioner is neither owner nor driver of the seized vehicle . No incriminating material has been recovered from the conscious possession of petitioner and he is no way connected with the alleged occurrence . Petitioner claims clean antecedent. 5 . Learned APP for the State vehemently opposed

Considering the fact that petitioner is neither owner nor driver of seized vehicle , clean antecedent and other circumstances of the case , this anticipatory bail is allowed and it is ordered that let the above named petitioner in the event of his arrest/surrender before the court below within a period of eight weeks from today, be enlarged on bail on furnishing bailbond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned ASJ Cum Exclusive special Judge Excise 4 Gaya in connection with Gurpa P. S. Case No. 04 of 2025 , subject to condition as laid down under Section 482 ( 2 ) of BNSS 2023 .
