JUSTICE SANJAY PRIYA ORAL ORDER 06-11-2018 Heard learned counsel for the petitioner and the State. The petitioner seeks bail in Bidupur P.S. Case No. 371 of 2017 instituted for the offence under Sections 3/4 of Explosive Substance Act.

Counsel for the petitioner submits that recovery is alleged to have been made from house of this petitioner but seizure list does not bear signature either of the petitioner or any of his family members. Counsel for the petitioner further submits that seizure list is part of the First Information Report. From the seizure list it appears that no explosive substance has been seized from the house of the petitioner.

Petitioner is said to be in custody since 19.01.2018. Considering the aforesaid facts and circumstances of

Patna High Court Cr.Misc. No.66273 of 2018 (2) dt.06-11-2018 2/2 the case, prayer for bail of the petitioner is allowed. Let the petitioner above named, be released on bail on furnishing bail bond of Rs.10,000/- (Ten thousand) with two sureties of the like amount each to the satisfaction of learned Additional Chief Judicial Magistrate, XIV, Vaishali at Hajipur, in connection with Bidupur P.S.
