The petitioner is apprehending his arrest in connection with Mojahidpur (Babarganj) P.S.Case No. 227 of 2015 registered for the offences punishable under Sections 341,307, 326, 504, 506, 34 of the Indian Penal Code and Sections 3, 4 & 5 of the Explosive Substance Act.

It has been submitted on behalf of the petitioner that no specific allegation is made against the petitioner and whatever allegation is there, that is against other persons and there is land dispute between the parties and both the parties are agnates. Heard learned APP also.

Having heard both sides and considering the fact stated in the FIR it appears that petitioner along with others went

Patna High Court Cr.Misc. No.4311 of 2017 (2) dt.10-02-2017 2/2 to the house of the informant and one co-accused threw bomb, which exploded, and thereafter other co-accused exploded another bomb. Hence, considering the allegations as stated above, I am not inclined to grant anticipatory bail to the petitioner. The petitioner may surrender and pray for regular bail in the court below, which shall be considered and disposed of on its own merit, without being prejudiced by this order and while considering bail, he will examine individual case of each of the accused persons.
