JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 12-12-2018 Heard learned counsel for the petitioners as well as learned Additional Public Prosecutor for the State. Petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 325, 504, 307/34 of the Indian Penal Code.
Petitioners and informant are agnates and it is admitted fact of the present case that the alleged occurrence took place on account of partition dispute. It is alleged that petitioner no. 1 gave lathi blow causing head injury to the informant whereas petitioner no. 2 and F.I.R named accused Yogendra Bind assaulted the informant by means of iron rod and lathi. Patna High Court Cr.Misc. No.64489 of 2018(2) dt.12-12-2018 2/2 two injuries, out of them, one injury which was found on right index finger was grievous in nature whereas another injury which was found on occipital region was simple in nature. Considering the aforesaid facts and circumstances as well as submissions of the parties, this anticipatory bail petition is allowed and it is ordered that petitioners, in the event of their arrest/ surrender within four weeks from the date of receipt of this order to the court concerned, shall be released on bail on furnishing bail bonds of Rs 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Additional Chief Judicial Magistrate 1st, Arwal in Rampur Chauram P.S. Case No. 17 of 2018 subject to condition as laid down under Section 438(2) of the Cr.P.C.
