The petitioners seek bail in a case instituted under Section 302/34 of the Indian Penal Code.
The allegation against the accused persons including the petitioners are of committing assault upon the informant and his family members, in which, his mother became badly injured. Thereafter she was referred to Sadar Hospital, Saharsa for better treatment, where she died.
It has been submitted on behalf of the petitioners that the petitioner no.1 is in custody since 16.02.2016 and the petitioner no.2 is in custody since 06.04.2016. The charge sheet has been submitted in the present case. There is no allegation of
Patna High Court Cr.Misc. No.50377 of 2016 (2) dt.22-11-2016 2/2 tampering of witnesses alleged against the petitioners. The petitioners have falsely been implicated in the present case. General and omnibus allegation has been made against them. No specific injury has been attributed against the petitioners. The other co-accused has been granted bail vide Annexure-2 to the present application.
On behalf of the state, it has been submitted that the petitioners are named in the F.I.R.
Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned 1st Additional Sessions Judge, Saharsa in connection with S.T. No. 175 of 2016, arising out of Sour Bazar P.S. Case No. 49 of 2016. (Sudhir Singh, J.) Amit/- U T
