JUSTICE SHIVAJI PANDEY ORAL ORDER 11-06-2020 Heard learned counsel for the petitioner and learned counsel for the State through virtual court proceeding. In this case, the petitioner is seeking bail in connection with Maniyari P.S. Case No. 310 of 2019 registered for offences under sections 272, 273/34 of the Indian Penal Code and Section 30(a), 34, 36, 38, 41, 56(d) of the Bihar Prohibition and Excise Act, 2016.

As per allegation, the police has intercepted a Hywa Truck bearing registration no. RJ07GA-4221 from which 3075.420 litres of illicit foreign liquor were recovered. Learned counsel for the petitioner submits that the petitioner has got no criminal antecedent.

Looking to the quantity of liquor recovered as also

Patna High Court CR. MISC. No.19188 of 2020(2) dt.11-06-2020 2/2 considering the entire facts and circumstances of the case, this Court is not inclined to grant bail to the petitioner. Accordingly, the prayer for bail of the petitioner, above named, is rejected with a liberty to renew his prayer for bail after completion of one year of his judicial custody.
