2. In the present case, the petitioner seeks bail in connection with Agiaon Bazar P.S. Case No. 19 of 2024 registered on 04.03.2024 for the alleged offences under Sections 302/34 of the Indian Penal Code.

3. As per prosecution case, the sister of the informant was married with the petitioner and the petitioner regularly used to beat her. As the petitioner was bent upon selling his land which was opposed by the deceased, the petitioner and coaccused Abhishek Kumar Singh, assaulted the sister of the informant. She was taken to hospital but died during course of treatment.

4. Learned counsel for the petitioner submits that the

The marriage was solemnized in the year 2003 and out of this marriage there is one daughter aged about 8 years. Petitioner was having good relationship with his deceased wife and he has no motive to kill her. FIR has been lodged after delay of one day and the prosecution story is not believable. The informant is not an eye-witness and in fact there is no independent witness to the alleged occurrence. There is allegation is that the petitioner used to regularly assault the sister of the informant, there was no previous complaint in this regard. Learned counsel further submits that cause of death is stated to be head injury in the post-mortem report. It appears the deceased received the head injury by falling while doing her daily chores. It is the family members of the petitioner who took the deceased to the hospital. Petitioner is in custody since 05.03.2024 and charge sheet has been submitted. Petitioner is having clean antecedent.

5. Learned APP opposes the submission made on behalf of the petitioner. Learned APP submits that the sister of the informant was assaulted in her matrimonial home and the defence of the petitioner is that the sister of the informant received fatal head injury in course of her daily routine is not

Having regard to the facts and circumstances and submissions made on behalf of the parties and considering the seriousness of allegation which is direct and specific against the petitioner and co-accused and gravity of offence, I am not inclined to grant bail to the petitioner. Hence, the prayer for bail is rejected.

7. However, the learned trial court is directed to expedite the trial considering the fact that the petitioner is in custody since 05.03.2024.
