JUSTICE VINOD KUMAR SINHA ORAL ORDER 26-10-2018 Heard learned counsel for the petitioner and the learned A.P.P. for the State.

The Petitioner seeks regular bail in connection with Dighwara P.S.Case No. 211 of 2017, registered for offences punishable under Section 394 of the Indian Penal Code. Allegation against the petitioner as per F.I.R. is that the on the point of pistol, the petitioner along with other miscreants have snatched his bag with cash Rs 67,586/-, a Samsung mobile and key of the motorcycle and other papers and fled away.

Submission of the learned counsel for the petitioner is that the petitioner has falsely been implicated in this case and the name of the petitioner transpires only on the confessional

Patna High Court Cr.Misc. No.64405 of 2018 (2) dt.26-10-2018 2/2 statement of co-accused and other co-accused has been granted bail by a Co-ordinate Bench of this Court vide order dated 06.04.2018 passed in Cr. Misc. No. 14257 of 2018. It is also submitted that no TIP has been done to the petitioner and he is in custody since 13.02.2018.

Heard learned A.P.P also.

Having heard both sides and in view of the facts and circumstances, as stated above, let the petitioners, above named, be enlarged on bail on furnishing bail bond of Rs. 25,000/- ( Rupees Twenty five thousand)each with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, 1st class, Chapra in connection with Dighwara P.S.Case No. 211 of 2017, subject to the following conditions:- i) One of the bailors of the petitioner shall be a local person having sufficient immovable property within the jurisdiction of the concerned Court. ii) The petitioner will not induce any witness or tamper with the evidence.
