Heard learned counsel for the petitioner as well as learned Addl. Public Prosecutor for the State.

Petitioner seeks bail in a case registered under section 394 of the Indian Penal Code.

Earlier prayer for bail of the petitioner was rejected by this court taking note of this fact that the petitioner was identified by the witnesses in test identification parade but submission on behalf of the petitioner is that having similar allegation co-accused Niraj Kumar has already been granted privilege of bail by this court vide order dated 28.9.2016 passed in Cr. Misc. no. 22220/2016 and so far as the petitioner is concerned, he is in jail custody since 10.2.2015 and up till now, his trial has not been concluded.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on

Patna High Court Cr.Misc. No.45011 of 2016 (2) dt.19-10-2016 furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the satisfaction of Addl. Sessions Judge VI, Nalanda at Biharsharif in Sessions Trial no. 40/2016 arising out of Sare P.S. Case no. 04/2015.
