The petitioner seeks bail in a case registered for the offences punishable under Sections 8, 20 (b)(ii), (c), 25 and 29 of the Narcotic Drugs and Psychotropic Substances Act and Sections 411, 420, 467, 468, 471 and 120(B) of the Indian Penal Code.

This is the second attempt of the petitioner to seek bail in case under Narcotic Drugs and Psychotropic Substances where commercial quantity of ganja weighing 2386 kg was recovered and the petitioner was arrested from the spot. The petitioner has moved earlier seeking bail by filing Cr. Misc. No. 61105 of 2021 and the same was permitted to be

Patna High Court CR. MISC. No.23442 of 2023(2) dt.03-05-2023 2/2 withdrawn by order dated 21.03.2022 with liberty to the petitioner to move before an appropriate forum in accordance with law.

Considering the facts that the recovery is huge and the charges have been framed, the Court is not inclined to release the petitioner on bail.
