Petitioner seeks bail in a case registered under sections 302, 404/34 of the Indian Penal Code and 27 of the Arms Act. Petitioner is named in the first information report but only suspicion has been raised against the petitioner on account of business rivalry. Submission on behalf of the petitioner is that even after completion of investigation, no cogent material except suspicion has come against the petitioner who is languishing in jail custody since 30.8.2016. It is further submitted that prior to institution of the present case, petitioner has not been made accused in any other case.
Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner be released on bail on furnishing bail bonds of Rs 10,000/- with two sureties of the like amount each to the
Patna High Court Cr.Misc. No.47533 of 2016 (2) dt.09-01-2017 2/2 satisfaction of the Chief Judicial Magistrate, West Champaran at Bettiah in Majhaulia P.S. Case no. 237/2016.
