JUSTICE VINOD KUMAR SINHA ORAL ORDER 03-03-2017 This is an application for grant of anticipatory bail for offences punishable under Sections 406, 420, 467, 468 and 471/34 of the Indian Penal Code.

Heard learned counsel for the petitioner.

It has been submitted on behalf of the petitioner that petitioner had taken loan of Rs. 8 lacs and now that has become Rs.11 lacs. For that a proceeding is also going on. Petitioner has some problem in the business and, as such, he could not deposit the amount.

Heard learned A.P.P. also. He has stated that earlier also three cases have been lodged against this petitioner. Having heard both sides, in view of the facts stated

No.8800 of 2017 (2) dt.03-03-2017 2/3 above, petitioner may surrender in the court below, i.e., Chief Judicial Magistrate, West Champaran at Bettiah, in connection with Bettiah Town P.S. Case no. 560 of 2016 and deposit the amount within a period of four months. On the first week of the first month he will deposit at least Rs.3 lacs through bank draft in the court below and the rest amount will be deposited within the next three months in equal instalments. All instalments should be paid within first week of every month. If petitioner deposits Rs.3 lacs as per the time stipulated above, the court below will grant him provisional bail on furnishing bail bond of Rs.

25,000/- with two sureties of the like amount each to its own satisfaction with conditions that he will deposit the rest amount in three equal instalments on the first week of each month from the next month of the first instalment. In the event of failure to deposit the amount through instalments, his provisional bail will be liable to be cancelled automatically and if the whole amount is paid as per the conditions stated above, and on being satisfied learned court below shall confirm his provisional bail, otherwise he is free to pass any other order or orders as he may deem fit and proper. Accordingly, this application stands disposed of.
