Petitioner seeks bail in Lauriya P.S. Case No.147/17 registered for the offence under Sections 272, 273, 420, 467, 468, 471, 120B, 414 of the I.P.C. and Sections 30A, 35A, 36, 38, 41, 47 of Bihar Prohibition and Excise Act.

Allegation is of recovery of liquor in different quantity from the vehicle and the name of the petitioner came on discloser of the other co-accused persons stating that they along with the petitioner were running syndicate.

Submission on behalf of the learned counsel for the petitioner is that the petitioner has been falsely implicated in this case. Nothing has been recovered from his possession. He is in custody since 21.06.2018 having no criminal antecedent. He

Patna High Court Cr.Misc. No.64827 of 2018 (2) dt.01-11-2018 2/2 further submits that similarly situated co-accused Anil Kumar has already been granted anticipatory bail by a coordinate Bench of this Court vide order dated 09.11.2017 passed in Criminal Misc. No.53718/17.

Heard the learned A.P.P. also.

Having heard both sides and in view of the facts and circumstances of the case, stated above, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.25,000/- with two sureties of the like amount each to the satisfaction of Special Judge, Excise, Bettiah, West Champaran, in Lauriya P.S. Case No.147/17 subject to the condition that bailers must be of local having sufficient properties within the jurisdiction of the court concerned.
