JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 22-11-2018 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 30(a), 38(1) of the Bihar Prohibition and Excise Amendment Act, 2018.

Petitioner and one Nitu Devi were found sitting near two bags in which country made liquor had been kept. Submission on behalf of the petitioner is that the said recovery has not been made from conscious possession of the petitioner and moreover, petitioner does not have any criminal antecedent and is languishing in jail custody since 02.09.2018.
