Petitioner is apprehending her arrest in connection with Kotwali (Barari) P.S. Case No.699 of 2023, registered for the offence punishable u/s 341/323/307/316/34 of the IPC. 3.

Allegedly, the petitioner is said to have assaulted the wife of informant on her abdomen due to which suffered miscarriage. 4.

It is submitted by learned counsel for the petitioner that petitioner is quite innocent and has not committed any offence. She has been falsely implicated in this case due to ulterior motive. No such occurrence in the manner as alleged has ever taken place. It is submitted that there is an inordinate delay of three days in lodging the F.I.R., which casts serious doubt about

Patna High Court CR. MISC. No.25944 of 2024(3) dt.18-09-2024 2/2 the prosecution case. Parties are agnates and there is a prior property dispute between them. Petitioner has no criminal antecedent.

Learned APP for the State opposed the prayer for bail by submitting that there is specific allegation against the petitioner. 6.

Considering the aforesaid facts and circumstances and the nature of allegation, I am not inclined to enlarge the petitioner on bail. The prayer for grant of anticipatory bail on her behalf is hereby rejected.

This application is accordingly dismissed.
