Heard learned counsel for the petitioners.
It has been submitted on behalf of the petitioners that petitioner no. 1 is the Chairman of PACS and petitioner no. 2 is the Assistant Manager of PACS and allegation is that they have taken loan from the Co-operative Bank for purchase of paddy but they have not repaid the amount as per agreement. However, it is submitted that petitioners have deposited the loan amount in the
Patna High Court Cr.Misc. No.3199 of 2017 (2) dt.08-02-2017 2/2 bank.
Heard learned A.P.P. also.
Having heard both sides, in view of the fact that petitioners have deposited the loan amount in the bank. let above named petitioners, in the event of arrest or surrender within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bail bond of Rs.50,000/- (Fifty thousand only) each with two sureties of the like amount each to the satisfaction of learned Judicial Magistrate, Ist Class, Udakishanganj, Madhepura, in connection with Gwalpara P.S. Case no. 58 of 2016 ( G.R. No. 572 of 2016) subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure. There are other conditions also that bailors should be local having property within the jurisdiction of the court concerned and petitioners shall cooperate in the investigation and make themselves available before the police as and when required.
