The petitioner seeks bail in connection with Raxaul P.S. Case No. 89/2016, registered for the offences punishable under Sections 25(1-b)a, 26, 27 and 35 of the Arms Act. The petitioner and other accused were caught by the police when they made attempt to forcibly take possession of the land.
Submission is that the petitioner is a license holder of the arms which has been recovered from his possession. It is further submitted that similarly situated co-accused persons have been granted bail by this Hon'ble Court vide Cr. Misc No. 52958/2016 and others have also been granted bail.
Patna High Court Cr.Misc. No.1539 of 2017 (2) dt.17-01-2017 2/2 Learned A.P.P. fairly submits that several accused persons have been granted bail in this case.
In the facts and circumstances stated above, the petitioner, above named, is also directed to be released on bail on execution of bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the learned Sub Divisional Judicial Magistrate, Raxaul at Motihari in connection with Raxaul P.S. Case No. 89/2016, subject to the conditions that one of the bailors must be near relative and another having sufficient immovable property within the territorial jurisdiction of the court concerned and the petitioner shall remain present on each and every date during trial and the default on two consecutive dates on his part without any reason shall disentitle the petitioner from privilege of bail.
