This application has been filed on behalf of the petitioners for quashing the order dated 18.08.2007 passed by learned SDJM, Patna in Complaint Case No. 3666(c) of 2005. It has been submitted by the learned counsel for the petitioners that the O.P. No. 02 has already received his money and therefore he was not appearing and now a report has come that O.P. No. 02 has already died.

In that view of the matter, this application is disposed of with a liberty to the petitioners to file an application under Section 205 of the Cr.P.C. and once that application is filed, the Court below will allow that application and thereafter dispose of the case if the legal heirs of the opposite party No. 02 do not appear for the next two months.
