2. The petitioner seeks bail in connection with Sessions Trial No. 974 of 2024, CIS No. 5 of 2025 arising out of Valmikinagar P.S. Case No. 79 of 2024 instituted for the offences under Sections 103(1), 123, 61 of the Bharatiya Nyaya Sanhita, 2023.

3. Prosecution case, in short, is that, the accused persons including the petitioner have committed the murder of the informant's daughter by administering poison.

4. Learned counsel for the petitioner submitted that the petitioner has falsely been implicated in the present case. Learned counsel further submitted that petitioner is the husband

Patna High Court CR. MISC. No.20275 of 2025(3) dt.09-07-2025 2/3 of the deceased and he was living happily with her wife, i.e. deceased for the last seven years. Learned counsel further submitted that petitioner never administered poison to the deceased but, as a matter of fact, she herself consumed the same and due to which she died. Learned counsel for the petitioner submitted that general and omnibus allegation has been made against the petitioner. It has been submitted on behalf of the petitioner that the petitioner is in custody since 21.08.2024 and has no criminal antecedent.

5. Learned A.P.P. for the State has vehemently opposed the prayer for grant of bail to the petitioner. Learned APP further submitted that petitioner is the husband of the deceased and there is direct allegation against the petitioner that he along with others forcibly administered poison to the deceased, as a result of which the deceased died. Learned APP further submitted that as per the FSL report of the deceased, poisoning is suspected.

6. Considering the aforesaid facts and circumstances of the case, direct allegation against the petitioner, who is the husband of the deceased as also the nature and gravity of offence, this Court is not inclined to grant bail to the petitioner at this stage.

7. Accordingly, the prayer for grant of bail to the petitioner is, hereby, rejected.
