JUSTICE MOHIT KUMAR SHAH ORAL ORDER 05-06-2020 The present petition has been taken up for consideration through the mode of Video conferencing in view of the prevailing lock-down on account of COVID 19 Pandemic, requiring social distancing.

Heard the learned counsel for the petitioner and the learned APP appearing for the State.

The petitioner seeks regular bail in connection with Naya Ram Nagar P.S. Case No. 276 of 2019, registered for the offence punishable under Sections 302, 307, 324, 386, 34 of the Indian Penal Code and Section 27 of the Arms Act.

The allegation of killing the deceased is on the coaccused person, namely, Aman Kumar and the said Aman

Patna High Court CR. MISC. No.18382 of 2020(2) dt.05-06-2020 2/3 Kumar is stated to have fired gunshots from the pistol being held by him in his hand on the deceased resulting in his death whereafter the other accused persons are stated to have assaulted the deceased.

The learned counsel for the petitioner has submitted that the petitioner is innocent, he is languishing in custody since 18.10.2019 and though, he is an accused in one other case, but he was granted bail from the police station itself. It is further submitted that similarly situated co-accused persons, namely, Chhotu Yadav and Sonu Yadav have already been granted regular bail by a coordinate Bench of this Court vide order dated 29.2.2020 passed in Criminal Miscellaneous No. 12140 of 2020.

Having regard to the facts and circumstances of the case, considering the submissions made by the learned counsel for the petitioner as also taking into account the parity of the case of the petitioner with that of the co-accused persons, who have already been granted bail by a coordinate Bench of this Court, I deem it fit and proper to enlarge the petitioner on regular bail. Accordingly, the above named petitioner is directed to be enlarged on bail on furnishing bail bonds of Rs.
