====================================================== CORAM: HONOURABLE MR. JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 16-07-2020 Heard learned counsel appearing for the petitioner as well as learned Additional Public Prosecutor for the State through video conferencing.
Petitioner seeks bail in connection with Chapra Muffasil P.S. Case No. 483 of 2019 registered for the offences punishable under Sections 147, 148, 323, 307, 379 and 354 of the Indian Penal Code.
Petitioner is said to have given Dabiya blow to injureds, namely, Sanjay Kumar and Jitendra Mahto. The photostat copy of injury report of injured Sanjay Kumar has been annexed as Annexure 2. The injury report of injured Sanjay Kumar goes to show that injured Sanjay Kumar has sustained injury measuring 1" x 1⁄2" x skin deep lacerated wound on his left parietal region. The opinion in the aforesaid injury was kept reserved. So far as injury report of injured Jitendra Kumar is concerned, the prosecution could not succeed to produce the injury report of aforesaid injured
Patna High Court CR. MISC. No.20337 of 2020(2) dt.16-07-2020 2/2 before Additional District and Sessions Judge XIII, Saran at Chapra, at the time of hearing of the bail petition of the petitioner. Considering the aforesaid facts and circumstances of the case as well as submission of the parties and also taking this fact that the petitioner is in jail custody since 25.12.2019, let the petitioner, above named, be released on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of learned Chief Judicial Magistrate, Saran at Chapra in connection with Muffasil P.S. Case No. 483/2019.
