The petitioner apprehends his arrest in Laheri P.S. Case No. 148/2015, registered for the offences punishable under Section 302 and other Sections of the Indian Penal Code and 27 of the Arms Act.

The informant alleged that his brother went along with Rumi Khan, Md. Iqbal @ Gorelal and Md. Munnan and others, but after some time he heard sound of firing and saw that his brother was shot dead. Md. Raju @ L.G., Rumi Khan and Md. Munnan are brothers. The petitioner is said to have threatened Salauddin to kill.

It is submitted that there is no material against the petitioner, but it appears that the petitioner has got enmity with the

Patna High Court Cr.Misc. No.38847 of 2015 (4) dt.17-12-2015 deceased and he had threatened to kill the deceased two weeks ago. The deceased had gone along with the petitioner and his brothers. The petitioner has got criminal antecedent and he is accused in many other cases including one registered under Section 302 of the Indian Penal Code.

Considering the facts aforesaid, I am not inclined to enlarge the petitioner above named on anticipatory bail. Accordingly, the same is rejected.
