The petitioner apprehends his arrest in a case under section 307 and other sections of the Indian Penal Code. The allegation against the petitioner is that he assaulted the informant with Khanti on his head. The anticipatory bail of the petitioner was earlier rejected on 14-5-2015 in Cr.Misc. No. 39920 of 2014, as the injury was opined to be grievous. It is submitted that the final injury report has been submitted and the injury is opined to be simple in nature, as there is no boney injury. There is a counter version. All the accused persons of the counter-case have already been granted anticipatory bail-vide order dated 1612-2014 in Cr.Misc. No. 43862 of 2014(Annexure-6). Considering the material on record, I do not find any new ground to consider the anticipatory bail of the petitioner. The

Patna High Court Cr.Misc. No.38905 of 2015 (2) dt.19-08-2015 2/2 prayer for anticipatory bail of the petitioner is rejected. The petitioner may, if so advised, surrender in the court below and pray for regular bail. The court below shall consider the prayer for regular bail without being prejudiced by this order and considering the fact that the accused persons in the counter-case have already been enlarged on anticipatory bail, and dispose of the same as soon as possible.
