The petitioner apprehends his arrest in Sarairanjan (Ghatho O.P.) P.S. Case No. 08 of 2017 registered for the offences punishable under Sections 272 and 273 of the Indian Penal Code, under Section 47(A), 57 of the Bihar Excise Act-2016 and Sections 30A, 38(I)(II) 41 and 47 of the Bihar Excise Act-2016. The informant after receiving input that the petitioner had concealed foreign liquor in a ditch situated by the side of his house and on such huge quantity of different brands of foreign liquor was recovered.
Learned counsel for the petitioner submits that there is nothing on record to show that the petitioner had kept liquor in the ditch. The field is open somebody might have kept the liquor. Considering the facts aforesaid and the fact that the

No.16327 of 2017 (2) dt.02-05-2017 2/2 petitioner has got no criminal antecedent, the petitioner above named, in the event of his arrest or surrender before the court below within a period of four weeks from the date of receipt/production of a copy of this order, is directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of the Judicial Magistrate-Ist Class, Samastipur in Sarairanjan (Ghatho O.P.) P.S. Case No. 08 of 2017, Subject to the conditions as laid down under Section 438 (2) of the Code of Criminal Procedure.
