08-07-2020 Heard learned counsel for the parties through video conferencing.
This relates to grant of bail in Banka (Barahat) P.S. Case No. 618 of 2019 registered for the offence under Sections 341, 323, 307, 504 and 506 of the Indian Penal Code. Later on, Section 302 of the Indian Penal Code was added. As per F.I.R., in the night of 31-10-2019, the petitioner entered into the house of informant and assaulted informant's sister brutally, due to which, she became injured and later on, during course of treatment, she succumbed to her injuries.
It is submitted on behalf of petitioner that petitioner is quiet innocent and has committed no offence, as alleged in the FIR. Entire prosecution story is false and concocted. The

No reliable material has been brought by the prosecution against the petitioner. The petitioner has got clean antecedent and he is in custody since 02-09-2019. However, learned A.P.P. for the State has vehemently opposed the prayer for bail and submitted that during course of investigation, specific material has been collected against the petitioner and as such, police submitted chargesheet under Section 302 of the I.P.C. against the petitioner. Considering the material available on record and the fact that after investigation, chargesheet was submitted against the petitioner under Section 302 of the I.P.C., I am not inclined to grant bail to the petitioner.
Accordingly, the bail application stands rejected. (Prabhat Kumar Singh, J.) anay U T
