Heard learned counsel for the petitioner and the State. Petitioner seeks regular bail in a case registered for the offences punishable under Sections 20 and 22 of the NDPS Act. As per allegation, 220 gram narcotic material suspected to be Ganja was recovered from Gumti (shop) of the petitioner. The main submissions advanced by the learned counsel for the petitioner are that petitioner has got no criminal antecedent and the informant lodged the present case with ulterior motive as he always demanded Pan, cigarette etc from the petitioner without paying cost of the said articles which was not fulfilled by the

Learned APP has opposed the prayer for bail.

In view of above submissions and considering quantity of alleged contraband which was suspected to be Ganja being small quantity and as per submission, petitioner has got no criminal antecedent, in my view, a lenient approach may be taken in respect of the petitioner. Let the petitioner be released on bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of the Sessions Judge, Sheikhpura in Sheikhpura P.S Case No. 104 of 2022 having NDPS Case no. 01/2022.
