JUSTICE MIHIR KUMAR JHA ORAL ORDER 15-04-2015 This case has been brought under the heading to be mentioned at the instance of learned counsel for the petitioner. he has stated that when the petitioner had sought to surrender in the court below by way of complying the order of this Court dated 20.03.2015, the draft of Rs. 2.25 lacs was not accepted by the court below because of there being no mention in the order of this Court dated 20.03.2015 in whose name such draft was to be deposited.

This Court fails to understand that when the trial court was directed to keep the amount of Rs. 2.25 lacs in the fixed deposit, there should have been, in the first place, no scope of confusion inasmuch as such draft was to be obviously made in the name of trial court because unless the amount could be credited in the account of the trial court, it could not keep the amount in fixed

That being so, if the petitioner even now would produce a bank draft, drawn in favour of the S.D.J.M., West Muzaffarpur, within two weeks from today, the rest of the order of this Court dated 20.03.2015 shall be complied with in letter and spirit in course of granting bail to the petitioner.
