JUSTICE ANIL KUMAR SINHA ORAL ORDER 19-07-2019 The petitioners apprehend their arrest in connection with Shikarpur P.S. Case No. 354 of 2018 registered under Sections 323, 498A, 494 and 504/34 of the Indian Penal Code. The allegation against the petitioners is of demand of dowry and due to non-fulfillment, petitioners along with others tortured the sister of the informant mentally and physically. Learned counsel for the petitioners submits that petitioners are innocent and they have falsely been implicated in this case. He further submits petitioners are elder brothers of the husband of the lady. Learned counsel further submits that sister of the informant has died due to illness and the informant with oblique motive has lodged this case inasmuch as per Panchayati,

After having heard learned counsel for the parties and taking into consideration the fact that there is general and omnibus allegation against the petitioners and petitioners are elder brothers of the husband of the lady who has died and there was a Panchayati held between the parties, as such I am inclined to grant anticipatory bail to the petitioner. Let the petitioners, abovenamed, in the event of arrest or surrender before the court below within a period of four weeks from the date of receipt of a copy of this order, be released on bail upon furnishing bail bond of Rs. 10,000/- each with two sureties of the like amount each to the satisfaction of the learned CJM, West Champaran at Bettiah in connection with Shikarpur P.S. Case No. 354 of 2018; subject to condition as laid down under Section 438(2) of the Code of Criminal Procedure. (Anil Kumar Sinha, J) sujit/- U T
