JUSTICE SUDHIR SINGH ORAL ORDER 28-09-2015 Heard learned counsel for the petitioners and learned counsel for the State The petitioners are apprehending their arrest in connection with Jehanabad Rail P.S. Case No. 39 of 2014 for the offences instituted under Sections 302, 201/34 of the IPC and 27 of the Arms Act.
The prosecution story, in brief, is that while remaining in contact on mobile phone, when the such contact could not be made after quite sometime in the evening, then on search being made, the dead body of the father of the informant was found near the railway track passing through Jehanabad Court Railway Station, thereupon the informant being his son instituted the case suspecting about the commission of the murder of his father by
Patna High Court Cr.Misc. No.39422 of 2015 (2) dt.28-09-2015 2/2 some unknown person.
It has been submitted on behalf of the petitioners that the petitioners have got no criminal antecedent. It is further submitted that petitioners are not named in the F.I.R. In course of investigation, the name of the petitioners has come on the basis of suspicion. Except for suspicion, there is no direct or indirect evidence against the petitioners. The petitioner no. 1 is lady. It is further submitted that the petitioners have been dragged in the present case due to enmity.
On behalf of the State it has been submitted that the petitioners' name has appeared in course of investigation. Considering the aforesaid facts and circumstances, let the petitioners above named, be released on bail in the event of their arrest or surrender before the learned court below within a period of four weeks from today in connection with Jehanabad Rail P.S. Case No. 39/2014 on furnishing bail bond of Rs. 10,000/-(Ten Thousand) each with two sureties of the like amount each to the satisfaction of the learned Railway Judicial Magistrate, Gaya, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
