JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 09-11-2020 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is in jail custody since 12.03.2019, seeks bail in a case registered for the offences punishable under Sections 302 of the Indian Penal Code and 27 of the Arms Act. Petitioner is not named in the first information report but in course of investigation, for the first time name of petitioner came in this case on the basis of information given by spy of the police. However, after that the investigating officer connected the petitioner with present crime on the basis of location of mobile as well as C.C.T.V Footage. Perusal of case diary goes to show that in C.C.T.V footage only one motorcycle and one Scooty were seen

Patna High Court CR. MISC. No.20573 of 2020(5) dt.09-11-2020 2/2 following, the Scooty of the deceased and the investigating officer and the witnesses could not identify the persons who were driving the said motorcycle as well as scooty. Petitioner does have criminal antecedent of several cases which is evident from perusal of Para-3 of the case dairy but submission on behalf of the petitioner is that petitioner was arrested in connection with Kotwali P.S.Case No. 126 of 2019 and after that he was remanded in several cases which had been lodged against the unknown persons.

Considering the aforesaid facts and circumstances as well as submissions of the parties, let the petitioner, above named, be released on bail on furnishing bail bonds of Rs. 10,000/- (Ten Thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Gaya in connection with Kotwali P.S.
