Petitioner prays for bail in connection with Maheshkhunt P.S.Case No. 169 of 2017, corresponding to G.R.No. 3411 of 2017, registered for the offences punishable under Sections 302 and 201 of the Indian Penal Code.
Petitioner is not named in the FIR and from FIR it appears that husband of informant had gone out and thereafter his dead body was recovered.
Submission of learned counsel for the petitioner is that petitioner has been made accused on the basis of confessional statement of co-accused and except that there is nothing against him and he is in custody since 28.8.2018.

Patna High Court Cr.Misc. No.63035 of 2018 (2) dt.25-10-2018 2/2 In view of the fact that investigation is still going on, I am not inclined to grant bail to the petitioner at this stage. However, once charge sheet has been submitted in this case petitioner may move before the court below and if the court below has found that except confessional statement there is nothing against the petitioner, the learned court below may pass an appropriate order, without being prejudiced by this order. With the above observation, this application is disposed of.
