The petitioners apprehend their arrest in a case registered for the offences punishable under Sections 341, 323, 354, 384, 386, 431, 504, 506, 509/34 of the Indian Penal Code. As per the FIR, when the informant was constructing road under seven Nishchay Scheme, in the meantime, all the accused persons including petitioners uprooted the bricks and demanded ransom of Rs. 2,00,000/-.
It is submitted that prosecution case is out and out false, concocted and fabricated case. As a matter of fact, on the
Patna High Court CR. MISC. No.21641 of 2022(2) dt.05-09-2022 2/2 objection raised by the petitioners over the construction of road on their private land, this false case was lodged after delay of five months. There is case and counter case. Counter case has been filed by the co-accused Md. Muhtaque bearing Sikty PS Case No. 58 of 2019 on 26.04.2019. Petitioners claim clean antecedents.
Considering the facts aforesaid, the petitioners abovenamed, in the event of their arrest/surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, are directed to be enlarged on bail on furnishing bail bond of Rs. 10,000/- (Ten thousand) each with two sureties of the like amount each to the satisfaction of the learned Chief Judicial Magistrate, Araria in connection with Sikty P.S. Case No. 112 of 2020, subject to the conditions as laid down under Section 438(2) of the Code of Criminal Procedure.
