Petitioner is in custody in connection with Nardiganj P.S. Case No. 256 of 2019 for the offence under sections 341, 323, 427, 353 and 504 of the Indian Penal Code and Section 37 (C) of the Bihar Prohibition and Excise Act, 2016. Learned counsel for the petitioner submits that petitioner has no criminal antecedent.

In this case, the petitioner was apprehend in a drunken condition and there is allegation against him that he has assaulted a government doctor and obstructed him in discharging his duty and also damaged the government property.

Considering the fact that petitioner has no criminal antecedent and he has remained in custody since 14.2.2020, the Court is inclined to grant bail to the petitioner, let the petitioner, named above, be enlarged on bail on furnishing bail bond of Rs. 25,000/- (Twenty five thousand) with two sureties of the like amount each to the satisfaction of learned Additional District and Sessions Judge 2nd cum Special Judge, Nawada, in connection with Nadriganj P.S. Case No. 256 of 2019 subject to the condition that on release the petitioner has to render his service as volunteer for a period of two months in Covid-19 hospital and he is required to report to the district Nodal Officer, who shall utilise the service of the petitioner appropriately.
