Petitioner seeks bail in connection with Nararikala Khurd P.S. Case No. 23 of 2012 registered under Sections- 147, 148, 149, 341, 323, 379, 427 of the Indian Penal Code and section 17 of the C.L.A. Act.
It is alleged that 1015 miscreants came and assaulted the informant while he was in his wine shop and snatched his mobile phone. They went from there raising pro MCC slogans.
Learned counsel for the petitioner submits that petitioner is not named in the first information report. It is further submitted nothing has been recovered from his
Patna High Court Cr.Misc. No.700 of 2017 (2) dt.13-01-2017 2/2 possession. It is further submitted that similarly situated coaccused has been granted bail by this Court vide order dated 03.10.2013 passed in Cr. Misc. No. 41325 of 2013. Learned counsel has produced the certified copy of the aforesaid order, which is kept on record.
Considering the facts and circumstances of the case specially the fact that co-accused has been granted bail by this Court, the petitioner above named is directed to be released on bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Chief Judicial Magistrate, Aurangabad, in connection with Naraikala Khurd P.S. Case No. 23 of 2012.
