Petitioners, who are in custody, seek bail in connection with Kudhani P.S. Case No. 390 of 2017 registered for the offences punishable under Section 392 of the Indian Penal Code.

FIR was registered against unknown. Name of the petitioners have surfaced in this case only on the basis of confessional statement of co-accused Manish Kumar. Nothing has been recovered from their possession. They are implicated in this case only on suspicion. Petitioner No. 1 is in custody since 08.06.2018 and petitioner No. 2 since 28.06.2018. Considering the aforesaid fact and circumstances of

No.63405 of 2018(2) dt.26-10-2018 2/2 the case, let the petitioners named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of learned A.C.J.M. Cum-Sub-Judge-3rd, West Muzaffarpur, in connection with Kudhani P.S. Case No. 390 of 2017 subject to the condition that:-

(1) Bailors should be local having sufficient immovable property within the jurisdiction of the court concerned

(2) Petitioners shall co-operate in the trial and shall be present on each and every dated fixed by the court and their absence on two consecutive dates without proper and sufficient reason the trial court will be at liberty to cancel their bail bond.

(3) If the petitioners tampers with the evidence or the witnesses of the case, in that case, prosecution will be at liberty to move for cancellation of bail of the petitioners.
