JUSTICE VINOD KUMAR SINHA ORAL ORDER 17-03-2017 The petitioner is apprehending his arrest in connection with Mairwa P.S. Case No. 240 of 2016, registered for offences punishable under Sections 323, 324, 341, 379, 307, 504/34 of the Indian Penal Code.
It has been submitted on behalf of the petitioner that earlier to filing of the present case, brother of the petitioner has lodged a case against informant and others and there is existing land dispute between the parties and the allegation against the petitioner that he assaulted the informant by means of farsa and the injuries caused to the hand and nose of the informant, however both the injuries were found to be simple in nature. Heard learned A.P.P. also.
Having heard both sides, considering the facts and circumstances of the case, nature of offence and also that the
Patna High Court Cr.Misc. No.8552 of 2017 (3) dt.17-03-2017 2/2 earlier to the filing of the present case by the informant, brother of the petitioner has filed a case against the informant and others and there is land dispute between the parties and the injuries inflicted by the petitioner on the informant were found to be simple in nature, as such, let the petitioner above named, in the event of her arrest or surrender before the court below within a period of six weeks from the date of receipt/production of a copy of this order, be enlarged on bail on furnishing bond of Rs. 25,000 (Rs. Twenty Five Thousand) learned ACJM-VII, Siwan, in connection with Mairwa P.S. Case No. 240 of 2016, subject to the conditions as laid down under Section 438(2) of the Cr.P.C. (Vinod Kumar Sinha, J) sunil/- U T
