JUSTICE KISHORE KUMAR MANDAL ORAL ORDER 22-11-2016 Heard learned counsel for the petitioner and the State. The petitioner although is not named in the FIR registered under section 394 IPC, but from the material on record including the order of the learned Addl. Sessions Judge it appears that on the statement of another co-accused the petitioner was arrested soon after the occurrence with the looted cash amount in the sum of Rs. 10,000/- It is submitted that the amount allegedly recovered from the petitioner cannot be said to be the looted cash amount. It is only the confessional statement of another co-accused. The petitioner is in custody since 19.08.2016.
Learned APP opposed the prayer and submitted that besides the incriminating material against the petitioner, it appears
Patna High Court Cr.Misc. No.47703 of 2016 (3) dt.22-11-2016 2/2 he is also required in another criminal case lodged under section 394 IPC.
Considering the facts and circumstances of the case, this Court, for the present, is not inclined to release the petitioner on bail. Prayer is accordingly rejected.
