Heard learned counsel for the petitioner no.2 and learned APP for the State.

The petitioner no.2 is apprehending his arrest in a case registered for the offence punishable under Sections 363 and 366(A)/34 of the Indian Penal Code.

It is a case abduction of the informant's daughter by the accused persons.

It is submitted by learned counsel for the petitioner that the petitioner has falsely been implicated in this case. He further submits that the main allegation is against co-accused Md. Taverz Ansari who had taken away the victim and no

No.21073 of 2022(3) dt.15-09-2022 2/2 specific allegation against the petitioner and the victim was recovered and her statement was recorded under Section 164 of the Cr.P.C. in which, she has not stated about the complicity of the petitioner in respect of her abduction. Petitioner no.2 has clean antecedent.

Learned APP appearing for the State has opposed the prayer for anticipatory bail.

Considering the aforesaid submissions, let the petitioner, namely, Md. Kashid Raza alias Md. Kashid Ansari, in the event of his arrest or surrender before the court below within a period of four weeks from today, be released on anticipatory bail on furnishing bail bonds of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Shri Arvind Mishra, Judicial Magistrate, Ist Class, Sitamarhi/concerned Court in connection with Sahiyara P.S. Case No. 92 of 2021, subject to the conditions as laid down under Section 438(2) of the Cr.P.C.
