A counter affidavit has been filed today on behalf of respondent no. 1 to 5. In paragraph '12' of the counter affidavit, it is stated that in course of investigation the allegations have been found true against the Managing Director, M/s GSCO Infrastructure Private Limited, Chandigarh of petitioner company but he is evading his arrest and is also not cooperating with the investigation.

This Court finds that this writ application has been filed by the petitioner company through it's Managing Director

Patna High Court CR. WJC No.698 of 2021(3) dt.19-09-2022 2/2 namely, Gurmeet Singh, age 51 year (Male), son of Bakhtwar Singh Resident of Village - Sector -33B, P.S.- Sector- 19, Chandigarh, Distt.- Chandigarh-160020.

In the given facts and circumstances, particularly taking note of the statements made in paragraph '12' of the counter affidavit that the case has been found true and the Managing Director is not cooperating with the investigation, and further that even in this Court learned counsel for the petitioner has not appeared, the prayer made on behalf of the petitioner to quash the First Information Report is not fit to be considered.
