Petitioner, who is in custody, seeks bail in connection with Trial No. 2713 of 2018 arising out of Sugauli P.S. Case No. 145 of 2018 registered for the offences punishable under Section 379 & 414 of the Indian Penal Code. Allegation against the petitioner is of theft of motorcycle of the informant.
It has been submitted on behalf of the petitioner that petitioner is innocent and committed no offence and has been falsely implicated in this case. Petitioner is not named in the F.I.R. The name of the petitioner has surfaced on the basis of confessional statement of co-accused Anil Kumar and Farman. Nothing has been recovered from possession of the
Patna High Court Cr.Misc. No.63294 of 2018(2) dt.26-10-2018 2/2 petitioner or from the house of the petitioner and he is in custody since 16.05.2018.
Considering the aforesaid fact and circumstances of the case, let the petitioner named above be released on bail upon furnishing bail bond of Rs. 10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of Sri S.M. Tripathi, Judicial Magistrate, Sadar Motihari, East Champaran, in connection with Trial No. 2713 of 2018 arising out of Sugauli P.S. Case no. 145 of 2018.
