JUSTICE VINOD KUMAR SINHA ORAL ORDER 07-05-2019 This is an application for grant of anticipatory bail in connection with Excise Special Case No. 9251 of 2018 arising out of Chowk P.S. Case No. 387 of 2018, disclosing offences under Section 30(a) of the Bihar Prohibition and Excise Act, 2016.
Allegation is of recovery of 30 liters Mahua liquor from the house of one co-accused person, who has named the petitioner. It further appears that the petitioner is accused in one more case.
Submission of learned counsel for the petitioner is that the petitioner has falsely been implicated in this case only on the basis of confessional statement of co-accused person and earlier also he has made accused in such a way.
Patna High Court CR. MISC. No.20160 of 2019(3) dt.07-05-2019 2/2 Heard learned A.P.P. also.
Having heard both sides, in view of the facts and circumstances of the case as stated above, I am not inclined to grant anticipatory bail to the petitioner, rather he should surrender and make prayer for regular bail, which will be considered on the basis of materials available on record, if possible, to be disposed of on the same day.
Accordingly, this application is dismissed.
