Heard learned counsel for the petitioner, learned counsel for the informant and learned A.P.P for the State. The petitioner seeks bail in Garkha P.S. Case No. 547 of 2019, registered for the offence punishable under Sections 25(1-b)a, 26 and 35 of the Arms Act. It is submitted on behalf of the petitioner that petitioner has falsely been implicated. Name of this petitioner has come in this case on the basis of confessional statement of co-accused. Nothing has been recovered from his possession. Petitioner is in custody since 10.01.2020.

Learned APP however, vehemently opposed the

Patna High Court CR. MISC. No.18752 of 2020(3) dt.09-07-2020 2/2 prayer for bail and submitted that co-accused Bhula Mahto was apprehended by the police who disclosed that petitioner is one of his accomplices.

Considering the nature of allegation and criminal antecedent of petitioner, I am not inclined to enlarge the petitioner above-named on bail. Accordingly, the same is rejected.
