The petitioner apprehended his arrest in Mohiuddin Nagar P.S. Case no. 68/2014 registered for the offence under Section 304B and other sections of the Indian Penal Code.

The father of the deceased made allegation against the petitioner and in-laws of the deceased that they burnt his daughter to death on account of non-fulfillment of dowry and the deceased has given birth to three female children.

It is submitted that all the allegations are false. Some altercation took place and on account of such the wife committed suicide by burning herself. The daughter of the deceased and the petitioner made her statement under Section 164 Cr.P.C. and she also disclosed the same facts. It appears that Sonali Singh, daughter of the deceased was present in the house and she disclosed that while she was watching T.V. her father

Patna High Court Cr.Misc. No.45905 of 2014 (2) dt.13-03-2015 chided her, but her mother try to pacify and on such her father assaulted her. Thereafter, her mother committed suicide by burning herself. It appears that the petitioner assaulted his wife and that is why his wife committed suicide. Hence, I am not inclined to enlarge the petitioner on anticipatory bail accordingly, the same is rejected. (Prabhat Kumar Jha, J.) Vinita/- U T
