By way of the present application preferred under Section 482 of the Code of Criminal Procedure, the petitioner seeks quashing of the order dated 20.02.2015 passed by learned Sessions Judge, Munger in Cr. Rev. No. 30 of 2014 affirming order dated 12.11.2013 passed by learned Judicial Magistrate Ist Class, Munger in Kharagpur P.S. case No. 140 of 2011 by which she has rejected the petition filed under Section 239 of the Code of Criminal Procedure for their discharge from the case on 03.04.2013.

I have perused the impugned order dated 12.11.2013 passed by the learned Judicial Magistrate and the revisional order

Patna High Court Cr.Misc. No.39153 of 2015 dt.15-07-2016 2/2 dated 20.02.2015 passed by the learned Sessions Judge, Munger. The instant application under Section 482 of the Code of Criminal Procedure is in the nature of second revision which is barred under Section 397 (3) of the Code of Criminal Procedure. Even otherwise, I find no irregularity in the orders passed by the learned Magistrate or by the court of Sessions.

Accordingly, this application is dismissed.
