JUSTICE HEMANT KUMAR SRIVASTAVA ORAL ORDER 06-12-2016 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner seeks bail in a case registered for the offences punishable under Sections 364(A), 120(B), 212 of the Indian Penal Code.
It is a serious case of Section 364(A) of the Indian Penal Code and in course of investigation, ATM card of victim was recovered from the house of the petitioner. Therefore, I am not inclined to release the petitioner on bail and hence, his prayer for bail in connection with Sessions Trial No. 404 of 2015 arising out of Nayagaon P.S. Case No. 111 of 2013 pending in the court of 1st Additional Sessions Judge, Saran at Chapra stands rejected.
