The petitioner apprehends his arrest in Complaint Case No. 1408 of 2015, Trial No. 3686 of 2016 instituted for the offence under Section 498(A) of the Indian Penal Code and under Section 4 of Dowry Prohibition Act.

The petitioner is the father-in-law of the informant. From the written report itself it appears that general and omnibus allegation has been made against the petitioner. It is mentioned in the written report that husband of the informant has died and thereafter this petitioner and other accused started committing torture with the informant for demand of dowry. From the written

Patna High Court Cr.Misc. No.4905 of 2017 (2) dt.15-02-2017 2/2 report, this court does not find any specific allegation of overt act of physical and mental cruelty committed by the petitioner. In the circumstances, prayer of the petitioner for anticipatory bail is allowed.

In the event of surrender/arrest of the petitioner, named above, within six weeks from today in connection with Complaint Case No. 1408 of 2015, Trial No. 3686 of 2016, he shall be released on anticipatory bail on furnishing bail bond of Rs.10,000/- (ten thousand) with two sureties of the like amount each to the satisfaction of learned Sub-Divisional Judicial Magistrate, West Muzaffarpur, subject to the conditions as laid down under Section 438(2) Cr.P.C.
