JUSTICE SUNIL KUMAR PANWAR ORAL ORDER 07-03-2022 Heard learned counsel for the petitioner as well as learned Additional Public Prosecutor for the State. Petitioner is apprehending his arrest in a case registered in connection with Doriganj P.S.Case No. 125 of 2020 for the offences punishable under Sections 376, 511, 379, 323/34 of the Bihar Prohibition and Excise Act 2016. As per allegation in the F.I.R, the informant stated that three accused persons including the petitioner entered into his house and outrage the modesty of her minor daughter Salini Kumari aged about 14 years.

Learned counsel for the petitioner submits that petitioner is falsely implicated in this case. Petitioner has got no criminal antecedent.

Learned Additional Public Prosecutor opposed the

Patna High Court CR. MISC. No.31296 of 2021(3) dt.07-03-2022 2/2 bail prayer of the petitioner and submitted that statement of victim recorded under section 164 o the Cr.P.C, in which she has supported the prosecution case and doctor assessed her age 14 years Considering the facts, I am not inclined to enlarge the petitioner on anticipatory bail and hence, his prayer for anticipatory bail stands rejected.

Petitioner is directed to surrender before the court below and seek regular bail.
