JUSTICE RAJENDRA KUMAR MISHRA ORAL ORDER 11-04-2017 Heard learned counsel for the petitioners and the learned A.P.P. for the State.

The petitioners apprehend their arrest in connection with Kaler P.S. Case no. 26 of 2016, registered under Sections 304(B), 201 and 120(B) of the Indian Penal Code.

The accusation is of killing of the daughter of the informant by her husband, brother-in-law and sister-in-law due to non fulfillment of demand of dowry and also to dispose of her dead body. Learned counsel for the petitioners submits that admittedly both the petitioners are brother-in-law (Devar) of the deceased. Further submission is that after death of the mother of the petitioners, the marriage of the deceased was performed with Harendra Singh in the year 2015 and thereafter, the deceased and her husband Harendra Singh used to reside in village house and the informant had

Patna High Court Cr.Misc. No.11977 of 2017 (2) dt.11-04-2017 2/2 also come at the house due to pregnancy of the deceased and both the petitioners were at Patna in connection with their studies. Further submission is that petitioners were not present in P.O village. Further submission is that Harendra Singh, husband of the deceased, is in custody since 17.10.2016. Further submission is that petitioners have no criminal antecedent and they are students. Having regard to the facts and circumstances of the case, let the above named petitioners, be released on bail, in the event of their arrest or surrender before the learned Court below within a period of four weeks from today, on furnishing bail bond of Rs. 10,000/- (ten thousand) each with two sureties of the like amount each to the satisfaction of the SDJM, Arwal in connection with Kaler P.S. Case No. 26 of 2016, subject to the condition as laid down under Section 438 (2) of the Cr.P.C.
