JUSTICE BIRENDRA KUMAR ORAL ORDER 25-10-2021 Let the defects, if any, be removed within four weeks of the start of the normal functioning of the Court. Heard learned counsel for the petitioner and learned Additional Public Prosecutor for the State.

The petitioner is languishing in custody for the offences punishable under Sections 406/147/302/201 of the Indian Penal Code.

Submission is that the petitioner and others are suspected to have committed murder of the father of the informant. Considering the fact that there is no eyewitnesses of the occurrence some other co-accused have been allowed bail by this Bench as well as by a coordinate Bench of this Court vide orders at Annexures-2 and 2/1 respectively. Investigation of the case is already complete.

No.30775 of 2021(2) dt.25-10-2021 2/2 Considering the fact that only material is suspicion against the petitioner, let the petitioner, above named, be released on bail on furnishing bail bond of Rs.20000/- (Twenty thousand) with two sureties of the like amount each to the satisfaction of the learned Court-below where the case is pending in connection with Dhansoi P.S. Case No.90 of 2018 with following conditions:

(a) Both the bailors shall be the resident of territorial jurisdiction of the learned Court-below.

(b) The petitioner shall fully cooperate with the trial of the case, failing which the court below shall be at liberty to cancel the bail bond of the petitioner.

(c) The petitioner shall not leave the country without permission of the trial Court.
